EXECUTIVE SUMMARY Asbestos is a naturally occurring mineral which, because of past commercial use, may be found in the ambient air in minute quantities, especially in urban environments. While the use of asbestos is now quite limited, it was for many years incorporated into thousands of common products. When asbestos is in place and in good condition, it does not pose a threat to health. Friable asbestos, that is prone to fragmentation or reduction to powder by hand pressure, can pose some threat to health under particular conditions. The occupational groups which should be monitored for risk of developing asbestos-related diseases are fire fighters, custodians, maintenance workers and asbestos abatement contract workers. Reducing the risk of disease among these groups should be the prime concern to legislators who are formulating regulations regarding asbestos. Whenever asbestos deteriorates and becomes friable, or when building renovation or demolition is necessary, removal or encapsulation may be required. By contrast, non-occupational exposure to asbestos which is in place and intact in public buildings does not appear to pose a significant health risk. Massive efforts to remove all asbestos from office buildings, schools and homes, even when it is in good repair, can result in the introduction of additional fibers to the ambient air. Such misguided public health measures may actually cause more harm than good. Asbestos removal is an expensive and serious undertaking. Improper removal methods can create more of an asbestos risk than existed before removal.
AsbestosThe earliest known use of asbestos was in about 2500 B.C. in what is now Finland, where asbestos fibers were mixed with clay to form stronger ceramic utensils and pots. The first written reference to asbestos came from Greece in about 300 B.C. when Theophrastus, one of Aristotles students, wrote a book entitled On Stones. In his book, he mentioned an unnamed mineral substance, which looked like rotten wood, yet was not consumed when doused with oil and ignited. The Greeks used it to make lamp wicks and other fireproof items. When the Roman naturalist and statesman Pliny the Elder wrote his comprehensive Natural History in about 60 A.D. , he described this fire-proof mineral and gave it the name asbestinon, meaning unquenchable, from which we get the English word asbestos.
Some people have been questioning the wisdom of attempting to remove all asbestos, particularly when it is in good condition and shows no signs of deterioration. There may be increased health risks from the removal process, including more airborne asbestos in the building for a number of years than before the removal. The relative risk of death from asbestos raises the issue of whether the money needed for removal could be better spent elsewhere.

INTRODUCTION Dean Monroe Freedman famously presents this problem in terms of the “perjury trilemma.”4 Dean Freedman notes that lawyers face three obligations in performance. The first two stem from the important, almost sacred, attorneyclient relationship. First, there is the duty to investigate a clients case. As Dean Freedman argues, “in order to give clients the effective assistance of counsel to which they are entitled, lawyers are required to seek out all relevant facts.”5 Second, there is the obligation of zealous client advocacy.6 These are potentially at odds with the third duty, the obligation of lawyers to the court. Lawyers are officers of the court and hold certain responsibilities as such.7 They have specific requirements imposed upon them in such a capacity that cannot be forsaken.8 disclosure of potential client perjury threatens the relationship between an individual accused of a crime and their one and only representative in the criminal justice system. “[T]o convert the defendants only champion into yet another member of the states legions seems an unnecessary and offensive step.”9 Dean Freedman argues that only two of these three obligations can be met at any given time.10 So which of the three should go? In our adversarial system, the relationship between a criminal defense attorney and her client is special. The first and second obligations are essential for zealous advocacy. 11 The third, however, is essential for lawyers as participants in the judicial system as a whole.12 This creates a complicated and difficult situation for a criminal defendant attorney.
“[L]awyers in criminal courts are necessities, not luxuries.”1 Of course, the record of Burdines trial cannot possibly indicate precisely when Mr. Cannon was asleep or awake or what trial happenings Cannon observed or missed because he was asleep. However, it was established that he missed “substantial portions” of the case against Calvin Burdine.14 Therefore, it is not surprising that the jury convicted Burdine of capital murder and sentenced him to death. What is surprising is that when Burdine complained of his trial counsels inexcusable behavior to Texass highest court of criminal appeals, the court summarily held that, although Burdine did prove that Cannon slept through substantial portions of Burdines capital murder trial, Burdine had not proven that he received ineffective assistance of counsel in violation of the Sixth Amendment.15 It was not until over sixteen years later that a divided court agreed with Burdine that the lawyering he received at his capital murder trial was constitutionally inadequate.16 Although ruling in Burdines favor, the court did so over strong and vociferous dissent.17

Cement use in the historic cemeteries of the French Quarter Although most concrete crypts and mausoleums are built in low-lying areas, where water could easily destroy a coffin, its not entirely true for the city of New Orleans. Basically, the majority, if not all, of the crypts and mausoleums in the cemeteries of New Orleans were built along the lines of traditional European cemeteries and to represent the architecture of a French city. In fact, many visitors to New Orleans have stated that these cemeteries do look like a miniature city-a “city of the dead”1 (Fig. 2 and 3). Most of the crypts and mausoleums in New Orleans are constructed of brick covered with a cement plaster (see Fig. 4). Even when these crypts and mausoleums need repair work done, workers use a mixture of both lime and cement. This combination does not detract from the original structure.2

The constant-dollar value of new construction put in place declined slightly in 1988 from the record set in 1987. (However, the 1988 current-dollar value of about $400 billion was a new record.) Small increases in public works construction were more than offset by declines in private construction. Although the number of housing starts fell 10 percent to 1.45 million units, the value of residential construction only decreased 2 percent because of a marked gain in average house size and an increase in home improvement spending. Public works construction increased slightly, led by strong spending for highways and schools. The lack of growth in private nonresidential construction was largely attributable to high vacancy rates for commercial buildings in most cities, as well as to the repeal of various tax benefits by the 1986 tax reform act. In 1988, the value of new construction put in place was equal to approximately 8.4 percent of gross national product (GNP). This represents a substantial recovery from the cyclical low of 7.7 percent of GNP in 1982, but is well below the post-World-War-Il peak of 11.9 percent attained in 1966. By this measure the construction share of GNP is expected to decline in 1989 (Figure 1-1). During the past decade, several types of construction activity that are not included in new construction data have grown rapidly. These include maintenance and repair, commercial/industrial renovation, and hazardous waste cleanup.

After the robust growth in 2006, construction activity posted even higher growth rates in 2007. The value of construction put in place surged by 18.5% over 2006. Activity in civil engineering increased by 24.7% as a result of the construction of transport infrastructure. The construction of buildings grew by 15.5%; within that, non-residential construction was up 20.2%, whereas activity in residential construction decreased by 0.9%. Based on detailed data on issued building permits, the vigorous construction of hotels appears to have continued last year, probably along with the construction of wholesale and retail trade buildings. In interpreting the figure on the value of residential construction put in place we should bear in mind that these figures exclude the activity of smaller firms (see the note under the table), where the construction of buildings is the main activity. Stronger growth was partly linked to favourable weather conditions, especially in the first half of the year. This is corroborated by the business trends regarding the limiting factors in construction. The share of firms that reported bad weather conditions as a limiting factor was much lower in the first half of 2007 than in the previous year. The weather was also more propitious than the year before in the third quarter, but it was less favourable in the fourth quarter, which affected growth in the latter part of the year. The growth in the number of employees increased further last year. In 2007 the number of people employed in the construction sector was 11.3% higher, on average, than in 2006. The number of workers by activity rose particularly in building completion; in the latter part of the year it also increased in general construction. In terms of employee status, higher growth rates were recorded in the number of sole proprietors and their employees.

Eugene, Ore.-based Caffe Diva is a chain of drive-through coffee cafes. In October 1997, the company filed a Small Corporate Offering Registration (SCOR) with the Securities Exchange Commission (SEC) in an attempt to raise $1 million, the annual limit that companies can raise through a SCOR offering. According to Ron Davis, a principal of Caffe Diva, the money was needed to expand the companys concept from the Pacific Northwest into national markets. Two years ago, we opened our first kiosk, and by early 1997 we had four in Lane County, Oregon, Davis said. But growing into other geographic areas takes money — lots of money. We considered many options. Banks were of little help. Angel investors wanted a substantial stake in the business, board membership, and veto power over expenditures and site selection. We didnt want to turn control over to outsiders. Finally, after investing two years and virtually all of our capital, a DPO (Direct Public Offering) through a SCOR seemed to be a better — and perhaps our only — option. Davis and his partners first learned about the SCOR program by reading a DataMerge advertisement in the Wall Street Journal that read, Do-It-Yourself DPO. Most of us have attempted a home remodel or oil change. Why not a direct public offering, Davis said.

The search for a missing southern Utah man is getting a boost from a team of private investigators. The Private Investigator Association of Utah is volunteering some of its members time and skills to help track down Christopher Coan. Its a case that has perplexed police and left his family heartbroken. Coan, 18, vanished from a Subway shop in Iron County on Sept. 3, 2007. He left his drivers license, clothing and money behind. His 1994 maroon and silver Chevy S-10 Blazer with stickers on the back window hasnt been found. The temporary license tag expired in October, and the vehicle has been listed as missing in a national crime database.

Kammerud, a doctoral candidate at Edgewood College, explored that question in a 2005 dissertation titled Spirituality and Superintendent Survival. He surveyed superintendents in Wisconsin with 10 or more years of experience on their perspective of their spirituality as well as their projected perception of how their employer, employees and family members noted their spirituality. In his principal findings, Kammerud, a former superintendent in Wisconsin, viewed:

Spacemen 3s “Walking with Jesus” and “Amen” (aka “Hey Man”) are here, as are early Spiritualized works “Feel So Sad” and “All of My Tears”. Yet its with the latter-day Spiritualized works, where Pierces more destructive or morose patterns gave way to an air of cautious hope, that the set really starts firing. The harmonica-laden “Broken Heart” and the call-and-response gospel of “Think Im in Love” are gently heartbreaking, while a medley of “Anything More” and “Ladies and Gentlemen We Are Floating in Space” serve to show off his widescreen songwriting talent like never before.

A widowed mother was found dead in her fume-filled car in the garage of her home with the body of her seven-year-old son in a bedroom above the garage in Penrith, Cumbria. Police said they did not believe Deborah Carruthers, 30, intended to harm her son Callum. An inquest was adjourned.
Garage storage is an $800 million retail business thats growing 10% a year. This is the fastest-growing area in home organization and storage, said Mike Franks, director of strategic planning at OSullivan Furniture. We all own a lot of stuff, and the garage has become the overflow valve for the rest of the house. Franks said OSullivans garage storage program licensed under the Coleman brand and carried at diverse retailers such as Lowes, Target, Pep Boys and Office Depot has sold phenomenally well since launched last fall. The whole system, including worktable, pegboard and cabinets, sells for less than $1,000. But the market is also strong for higher-end lines, such as Gladiator Garageworks by Whirlpool. Sauders answer to the Coleman line, for example, is a licensed Hot Rod Garage workshop organization system.
Steel fibres are gradually becoming an established reinforcement option of choice for prefabricated elements and structures. Their use increases the load-bearing capacity and durability of individual construction elements, and Hochtiefs prefabricated garage system has now received the approval of the German Institute for Construction Technology in Berlin. Formwork systems and process engineering are subject to continuous rationalisation. For safety and quality reasons, the company decided to base its application for approval on destructive testing rather than on computational methods. The results confirmed the work of the engineers, who took into account the conditions established by the new automated formwork equipment. A system of ground fixture and stabilisation suitable for all garage types was simultaneously developed. In August last year, this work gained Hochtief approval from the German Institute for Construction Technology for its steel fibre-reinforced concrete garage systems.

Cell phones beam RF energy that can penetrate the brain, which raised questions about cancers of the head and neck, brain tumors and leukemia. The Danish researchers compared phone records to the Danish Cancer Registry, which records every Danish citizen who gets cancer. Among those tracked through 2002, there were 14,249 cancers diagnosed, fewer than the 15,001 predicted from national cancer rates.
Cell phones and Blackberries are increasingly drawing the ire of educators and law enforcers. Although the vast majority of teens use cell phones to keep in touch with their families or social networking, these devices are being used, increasingly, for negative and/or illegal purposes. Text messages and camera phones are being used to cheat on tests. Cell phones also are being used to bait students into fights. In one case, a student recorded the altercation on a cell phone and showed it off to students at school the next day. Students have used text messaging to spread horrible gossip regarding the deaths of fellow classmates. School administrators have had to interrupt class time with overhead announcements to counteract such rumors.

Medical device maker Thermage Inc. of Hayward struggled out of the starting blocks Friday as the companys shares dropped almost 4 percent on its first day of trading as a public company. The company, which focuses on providing non-invasive procedures to reduce wrinkles and tighten skin, priced 6 million shares at $7 each in a bid to raise $42 million. On Friday, 2.3 million shares changed hands. Thermage earlier had hoped to price its offering between $11 and $13 a share, and then cut its price range to $8 to $9 a share. Merrill Lynch Co. ran the offering.

A new study funded by Motorola Corp. suggests that cell phones do not pose a cancer disk, reports Promotive Communications Inc. However, experts say its too soon to rule out a negative health impact of cell phones. A 13-nation study on the relationship between cell phones and brain tumors is under way. The results are expected to be released in 2004.

AN EXTRA 1,000 medical school places are to be created over the next seven years to head off a projected shortage of doctors in the millennium, ministers announced yesterday. The increase of a fifth - equivalent to a new medical school - will take the annual number of new doctors being trained in Britain from 5,000 to 6,000. The committee estimated that the demand for doctors will rise at 1.7 per cent per year over the next 20 years, similar to the trend in the last 20 years. It said that an increase of 1,000 in the annual medical student intake would not produce a domestic oversupply by the year 2020 “under any realistic scenario”.

More than 100 members and guests were at the March meeting of the California Retired Teachers Association. President Orville Johnson opened the meeting, which had a St. Patricks Day theme. Members Toni Kelly, Eleanor Moore and Rita Hammer donned huge Irish hats and sold raffle tickets to bring in scholarship money for teachers in training at Cal State Hayward. In June, the CRTA will award four $2,000 scholarships. After a traditional meal of corned beef and cabbage, program chair Doris Marciel introduced the San Lorenzo Village Singers. This group began as the PTA Mother Singers from Sunset Elementary School in the 1950s. In three-part harmony, they sang a variety of songs including show tunes, western songs and old favorites. Costumed in black with tuxedo shirts, the group of 20 ladies, under the direction of Chabot College professor Richard Dinwiddie and accompanied by Erika Uribe, delighted the listeners. It was an enjoyable afternoon for all. If only aprons could talk, what a tale they could tell. Judy Vetrovec impressed the members of the Castro Valley Womens Club at their last general meeting with her knowledge and history of the apron. Judy encouraged members to wear one of the many aprons as she talked about them.

Acne is associated with heavy sebum secretion caused by hormones Androgens (male hormones) stimulate sebum secretion and estrogen (a female hormone) reduces sebum production.


While the tendency to develop acne is passed from parent to child through genetics, certain practices can aggravate acne outbreak. Acne can be caused by mechanical itrritation, including pulling or stretching the skin, as often happens in athletic activities. Taking steroids can also aggravate acne because steroid drugs contain androgens. Adolescent women who use oil-based cosmetics and moisturizers can also have an aggravated case of acne.


The inflammation that defines acne results from the plugging of the sebaceous ducts, which lead from the sebaceous gland to the surface of the skin. Once plugged, the duct becomes inflamed and pustular. In some individuals the acne pustules are few, infrequent, and isolated. In others the condition is pronounced, with widespread pustule development.


Acne is not a debilitating medical condition, but people find it unsightly and may be unduly embarrassed and worried about their appearance. Since the pustules principally appear on the face, they are quite noticeable. Teenagers tend to be more self-conscious than older people, and so even mild acne can be quite distressing.


Manipulating or squeezing acne pustules can cause deep and permanent scarring. Washing the affected area with a germicidal soap and an abrasive sponge will help dislodge the material plugging the duct. Because estrogen inhibits the development of acne, taking birth control pills may alleviate acne in young women. A topical antibiotic may also prove helpful. For deeper acne, injected antibiotics may be necessary.

Not a day goes by without yet another article extolling the virtues of the Internet. An estimated 30 million worldwide users to date and more logging on every day. To the small business owner, the real question is, Where does the hype end and the reality begin? Is the Internet really a viable proposition for the traditional small business, normally constrained by lack of time, staff and money? 10 questions to ask yourself The best way to determine whether or not the Internet makes sense for your business is to apply a simple “yes” or “no” answer to 10 important marketing questions: 1. Do my clients require specific product information before they can buy my product/service? 2. Do I spend a majority of my time selling the benefits of my product only to be asked, “Can you send me more information?” 3. Is my long-distance phone bill more than $100 per month? 4. Have I lost business as a result of playing phone tag with a potential customer because I was unable to “sieze the moment?” 5. Would a new employee handling sales paperwork free me to increase my companys revenues? 6. Is there an international market for my product? 7. Does my product have a story to tell? 8. Am I spending more than 20 percent of every dollar I make on marketing-related expenses? 9. Would instant customer feedback benefit my business? 10. Would the ability to capture orders 24 hours a day, 365 days a year, help my business? If your product requires a lengthy explanation in order to communicate its benefits, the Web is the place to do it. Customers and prospects can view that information at their own pace — in many instances, via sophisticated video and audio commercials. Since were talking digital information here, there is very little difference between one word and one thousand words. And if you feel that youre spending too much time processing paperwork and not enough time selling, a well-designed Web page may be one of the potential keys to your businesses future success. How important is e-mail? An important byproduct of the Internet is e-mail, or electronic mail. Once you learn to use this valuable tool, youll wonder how you ever got along without it. Forget about what time it is, or whether its “worth a call” — with e-mail, it costs no more to send a message to Sydney that it does to Syracuse (the actual cost is about $1.00 an hour). And time zones become irrelevant as well. You and the recipient can view the messages at your convenience, thereby eliminating the dreaded game of telephone tag. So get serious! How does the smart business operator approach the formidable and intimidating task of investigating the Net? First, gather your thoughts as to what you would like your Web site to accomplish. Analyze each possible scenario and list all the information relevant to it. Then, and only then, begin to organize the scenarios into a flow chart. Once you have the flow chart polished, try to find flaws in it. If your customer is browsing through the pricing section of your flow chart, will he/she be more interested in going to shipping next or reading your companys mission statement? After you feel that youve developed a solid grasp of the different portions of the business that youd like to present to your clientele, you are now ready to interview potential agencies who are skilled in creating Web pages. According to Vick, there are 3 questions you should ask a potential Web page creator: 1. Have you done this before? 2. Who have you done this for? 3. May I call them? While creating some Web pages may require the skills of a computer Ph.D., most will not, and there are competent companies in most major markets capable of accomplishing the task in a cost-effective fashion. Prices for creating a simple Web site can range from a low of $2,500 to high of $20,000. In fact, some of the Fortune 500 marketers have created sophisticated and complex Web pages that can literally run into the hundreds of thousands of dollars, and in some cases, the millions. But for the average small business, the investment will probably be in the $5,000 to $10,000 range. And remember, you must keep your Web site content fresh, or your prospects will have no reason to come back. Seeing your own World Wide Web site up and running on the Internet can be a proud moment for any business owner. It also can mean the start of a whole new way of doing business. It has the potential to increase productivity by extending operating time to a full 24 hours a day. But this will only happen if your business really needs this technology and can use it effectively. Now, at the turn of the twenty-first century, new global media and audiences are reshaping this industry and the advertising we see. The next frontier is worldwide, and the new media are as open-ended as cyberspace. The tremendous growth of the Internet as an advertising medium has been widely documented in a variety of published articles and reports. Although advertisers still invest more than 45 percent of their media budget in newspaper and television, the Internet Advertising Bureau (IAB) estimates that more than $900 million was spent on Internet advertising in 1997 and projects that the end-of-year figures for 1998 will show an expenditure of at least $2 billion. Business Week predicts that ad spending on the Internet will be close to $8 billion by 2002.1 One important reason why revenue is increasing at such a rapid rate is that many ol the more established and popular Web sites are charging more for their ads. In general, advertisers pay for their ads on a “cost per thousand” (CPM) basis, i.e., advertisers pay a fee for every thousand times their ad is viewed. CPM rates for television range from $5 to $6 per thousand.
